Article 2 – Pricing
• The product prices are in Euros, inclusive of VAT and exclusive of shipping costs.
• All orders, regardless of their country of origin, are to be paid in Euros.
• Special offerings: special offerings are only valid for a limited, fixed period of time. In case there are more special offerings for the same products, C-Device reserves the right to make customers the most advantageous offer, because only one offering can be valid at the same time.
• C-Device reserves the right to change its prices at all times. The products are invoiced on the basis of the prices effective at the time of ordering, subject to availability.

Article 3 – Orders
We accept your orders under our General Terms of Sale. By placing an order you accept the validity of our General Terms of Sale.
You can place an order in several ways:

The product you ordered will be shipped after receipt of your payment (payment in advance / via Paypal / wired t/t).
Invoices will be sent by email or ordinary post. The invoice will also be included in the package.

Article 4 – Delivery
Products are delivered by registered post to the delivery address (including addresses in Europe) you specified when placing your order. The delivery time (delivery from stock) comprises the time needed for making the shipment ready for dispatch and sending the shipment and shall not exceed a period of 5 working days after receipt of the payment of the amount due on the bank account of C-Device. Packages are delivered by TNT (Dutch Post) or UPS.

Article 5 – Shipping costs
Shipping costs include the costs of preparing the shipment for dispatch and postage charges. The shipping costs depend on the number of products ordered and the method of shipment you have chosen. The costs of a ‘cash on delivery’ shipment (payment upon receipt of the goods) amount to EUR 15 (only in the Netherlands). The shipping costs for products paid in advance amount to EUR 9 (for Netherlands). Shipments to destinations outside of the Netherlands (Europe) are subject to other rates, mostly EUR 14.
Our customers are advised to try and include the products they wish to purchase in a single order as much as possible. We cannot combine products ordered separately in one shipment and the costs of sending several shipments will be invoiced separately. 

Article 6 – Payments
Payments fall due within 10 days after the invoice date. The amount due must be fully paid within the set period of time. C-Device shall be entitled at all times to demand full payment in advance, or to make the order processing subject to other conditions.
C-Device reserves the right to refuse, cancel or suspend an order or to dissolve the agreement, if the customer concerned fails to pay the agreed amount or fails to comply with any previous agreement.
Ordered and/or invoiced products can be paid in one of the following ways:
• advance payment by money transfer to our bank account no. 93.47.330 (please find below the bank details for international payment t/t).
• via Paypal using our Paypal email account
• by bank card or smart card when collecting the ordered product (please call in advance to make arrangements).

Article 7 – Confirmation
By clicking on “submit order” after having completed the ordering process you accept the order and these General Terms of Sale wholly and unconditionally.
The data held on record by C-Device constitute the evidence of all transactions between C-Device and the customer.

Article 8 – Availability
Our product offerings and prices are valid as long as they are mentioned on our website and as long as stocks last. Information about the availability of our products is provided when you place an order, i.e. when you select a product on our website. Availability information is only indicative.
Should a product prove to be out of stock after you have placed your order, we shall notify you  as soon as possible by email or telephone, offering you the opportunity to cancel or change your order. 

Article 9 – Retention of title
All products remain the property of C-Device until full payment is made, including any interest due. This provision is without prejudice to the risk of quality loss or damage passing to the buyer as soon as the products leave our premises.

Article 10 – Returns and warranty
The products sold by C-Device are new and come with a manufacturer’s warranty against defects. Defects resulting from improper use are not covered by the warranty. The shipping costs of returning the product will be borne by the customer.
C-Device reserves the right, however, to proceed to set off, if payment of a previous order is still outstanding.
Products sold through auction sites or private advertisements are excluded from warranty.
C-Device provides a standard 8-days money-back guarantee, provided that the product and the packaging are returned undamaged and fully intact. Within this 8-days period you may return the product to us at your own expense, including the invoice and an accompanying, signed letter. When we refund a product, we have to charge a (small) (handling) fee/cost, when returned products not complete, or damaged or in parts only.
(Translation) software packages that were opened, cannot be exchanged and do not qualify for a refund. 

Article 11 – Intellectual Property Rights
All texts, comments, illustrations and images on the website of C-Device Europe are copyrighted and protected worldwide by intellectual property law. Only private use is allowed, in accordance with the provisions of intellectual property law. Any other use made without the prior permission of C-Device constitutes an infringement of copyrights and intellectual property rights.

Article 12 – Dissolution
Any default on the part of the buyer entitles C-Device to dissolve the agreement wholly or in part by giving the buyer written notice. A notice sent to the buyer’s email address is also deemed to be a written notice. 

Article 13 – Liability
Dutch law applies to all the products offered for sale by C-Device. C-Device cannot be held liable, if the rules and regulations of the country where the products are delivered are not met.
C-Device cannot be held liable in the event of force majeure, political unrest, a partial or full strike of the postal services and means of transport or communication in particular, floods and fire.
C-Device cannot be held liable if third parties fail to meet their obligations towards C-Device, or do not perform these obligations in time, so that C-Device cannot deliver (in time).

Article 14 – Applicable law - Procedures
These Terms of Sale were drawn up in English and Dutch. Dutch law applies to these Terms of Sale. In the case of disputes the Dutch Court has sole jurisdiction.

Article 15 – Confidentiality
C-Device only collects the data that are absolutely required to process your order or to keep you informed of special offerings and new products.
The following information is never provided to third parties:
- The details you provide when completing the order form, placing an order.
- Details concerning your computer (IP address, operating system, browser type, etc.).

The data collected enable us to personally inform you of special offerings and to keep you informed of any developments and innovations in our range of products and services.

In accordance with the Personal Date Protection Act you are entitled to have access to, to correct and to object to all your personal data that we have on file. If you do not want third parties to use your data, you should notify us in writing (by ordinary post or email), mentioning your full name, email and postal address details.
